Digital Signature, Aadhaar eSign & Electronic Execution Policy

1.1 This Policy governs the use of electronic signature mechanisms, including Aadhaar-based eSign services and Digital Signature Certificates (DSC), facilitated through the Stamp Mitra platform.

1.2 The Platform acts solely as a technology-enabled facilitation interface enabling Users to electronically execute documents through licensed third-party service providers.

1.3 The Platform does not issue digital signatures, authenticate identities independently, or act as a Certifying Authority.

2.1 Electronic signatures and digital signatures are governed under the Information Technology Act, 2000, including applicable rules, regulations, and notifications issued by the Controller of Certifying Authorities (CCA).

2.2 Aadhaar-based eSign services are governed by regulations issued by the Unique Identification Authority of India (UIDAI) and the Ministry of Electronics and Information Technology (MeitY).

2.3 Digital Signature Certificates (DSC) are issued by licensed Certifying Authorities (CAs) under Indian law and are legally recognized for authentication of electronic records.

4.1 By opting for Aadhaar eSign or DSC, the User expressly:

1. Consents to electronic authentication and signature creation
2. Authorizes the use of Aadhaar-based identity verification (where applicable)
3. Agrees that such signatures shall have legal validity equivalent to handwritten signatures, subject to applicable law

4.2 The User acknowledges that OTP-based consent constitutes valid authorization under electronic records law.

5.1 Identity verification is performed by licensed third-party providers using Aadhaar authentication (OTP / biometric) or Certifying Authority infrastructure (for DSC).

5.2 The Platform does not store Aadhaar numbers or biometric data and relies on secure APIs provided by authorized service providers.

6.1 eSign and DSC services are provided by licensed entities, including eSign Service Providers (ESP) and Certifying Authorities (CA).

6.2 The Company does not control provider systems, does not guarantee uptime or availability, and shall not be liable for failures, delays, or errors arising from third-party systems.

7.1 Electronic signature transactions generate audit logs, including timestamp, IP address, authentication details, and transaction ID.

7.2 Such records are maintained by the respective service provider and may be used for legal verification.

7.3 Users are advised to download and securely retain executed documents and certificates.

8.1 Documents signed using Aadhaar eSign or DSC shall be considered valid electronic records, subject to compliance with applicable law and acceptance by relevant authorities.

8.2 The Platform does not guarantee acceptance by all institutions or jurisdictions.

Users shall not use another person’s Aadhaar or DSC without authorization, attempt identity spoofing or fraud, or use signatures for unlawful or misleading purposes.

11.1 The Company shall not be liable for authentication failures, incorrect identity verification, errors in signed documents, or rejection by authorities.

11.2 All liability related to identity verification and signature issuance rests with the respective licensed providers.

12.1 Sensitive identity data is processed by authorized providers under secure protocols. The Platform does not store Aadhaar numbers or biometric information.

12.2 Data handling is governed by the Platform’s Privacy Policy.
