Anti-Fraud & Misuse Policy

1. Scope, Objective and Applicability
1.1 This Anti-Fraud & Misuse Policy (“Policy”) governs the detection, prevention, investigation, and enforcement actions relating to fraudulent, unlawful, abusive, or unauthorized use of the Stamp Mitra platform (“Platform”).
1.2 This Policy applies to all Users, transactions, devices, and interactions conducted through or in connection with the Platform.
1.3 The Company maintains a strict zero-tolerance policy towards fraud, misrepresentation, identity misuse, unlawful documentation, and any activity that may compromise the integrity of the Platform or violate applicable laws.
2. Definitions
For the purpose of this Policy:
2.1 “Fraudulent Activity” includes any act intended to deceive, misrepresent, or unlawfully gain benefit.
2.2 “Misuse” includes any use of the Platform in violation of applicable laws, these Terms, or intended purpose.
2.3 “User” includes any individual or entity accessing or using the Platform.
3. Prohibited Conduct
Without limitation, the following activities are strictly prohibited:
- Impersonation, identity theft, or use of another person’s credentials, Aadhaar, or contact details without authorization;
- Submission of false, fabricated, incomplete, or misleading information;
- Procurement or attempted procurement of stamp papers or legal documents for unlawful, fraudulent, or misleading purposes;
- Use of stolen, unauthorized, or compromised payment instruments;
- Circumvention or attempted circumvention of Platform safeguards, including OTP authentication, verification checks, or system controls;
- Bulk submissions, automated requests, or use of bots/scripts to exploit system functionality;
- Structuring or splitting transactions to evade monitoring thresholds;
- Any activity that disrupts, interferes with, or compromises Platform operations or security;
- Use of the Platform for activities prohibited under applicable law.
4. Verification, Monitoring and Risk Assessment
4.1 The Company may deploy automated and manual systems for monitoring, including risk scoring algorithms, behavioral and transactional analysis, device and IP tracking, and anomaly detection systems.
4.2 The Company reserves the right to request additional documentation or verification at any stage, delay or suspend transactions pending verification, and conduct internal reviews and audits.
4.3 Monitoring mechanisms may be updated or modified without prior notice.
5. Enforcement Measures
5.1 Upon suspicion or detection of fraudulent or abusive activity, the Company may, at its sole discretion and without prior notice:
- Suspend, restrict, or terminate User access
- Place orders on hold or cancel transactions
- Refuse, reverse, or block payments as permitted under applicable law
- Block accounts, devices, IP addresses, or identifiers
- Withhold services or deny further access
- Retain transaction records and related evidence
5.2 The Company may also take precautionary action where fraud is suspected, even if not conclusively established.
6. Reporting to Authorities and Third Parties
6.1 The Company reserves the right to report suspicious or confirmed fraudulent activities to payment gateways, financial institutions, banking partners, and law enforcement or regulatory authorities.
6.2 Such reporting may be made without prior notice to the User where permitted or required by law.
7. User Obligations and Cooperation
7.1 Users shall provide accurate and verifiable information, comply with all verification requests, and cooperate with investigations.
7.2 Failure to cooperate may result in suspension, termination, cancellation of orders, or denial of services.
8. Evidence, Record Retention and Audit
8.1 The Company may retain transaction logs, device and session data, communication records, and verification documents.
8.2 Such records may be used for fraud investigation, legal proceedings, and regulatory compliance.
9. Legal Action and Recovery
9.1 The Company reserves the right to initiate civil proceedings for recovery of losses or criminal complaints under applicable law.
9.2 The Company may recover financial losses, legal costs, and administrative expenses arising from fraudulent or abusive conduct.
10. Chargebacks and Financial Misuse
10.1 Users shall not initiate unjustified chargebacks or disputes.
10.2 In case of fraudulent or abusive chargebacks, the Company may contest the dispute with evidence, recover associated costs, and block the User from further transactions.
11. Limitation of Liability
11.1 The Company shall not be liable for losses resulting from enforcement actions taken in good faith or delays/disruptions caused due to fraud prevention measures.
11.2 Actions taken under this Policy shall be deemed necessary for maintaining Platform integrity and compliance.
12. Disclaimer
Stamp Mitra is a facilitation platform operated by Bani Global Industries LLP and is not responsible for unlawful activities conducted by Users.
The Company undertakes reasonable efforts to prevent misuse but does not guarantee detection of all fraudulent activities.
